Principles of Data Processing

Personal data are all pieces of information which relate to an identifiable natural person. This includes, for instance, such information as your name, your phone number, your email or IP address. Information which we cannot link to your person, e.g. due to the anonymization of information, does not constitute personal data.

We are committed to the principle of data economy. We only collect, process, store, or transfer those data that are necessary for initiating or executing the respective business.

The processing of personal data always requires a legal basis or your consent. The personal data you provide during the initial business contact or for the execution of a business transaction are solely processed by our in-house systems for these purposes in accordance with the applicable data protection regulations. The processing of data is based on art. 6(1) lit. b and art. 6(1) lit. f General Data Protection Regulation (GDPR), supplemented by any applicable national legal provisions; for Germany, e.g., art. 88 GDPR in conjunction with section 26(1) Federal Data Protection Act (FDPA). Personal data that have been processed are deleted as soon as the purpose of the processing has been achieved and any retention obligations required by law no longer apply.

Revocation of Your Consent and request for information

You can revoke consent which you have previously granted without stating reasons by sending an email to data-protection@fms-logistics.com while preserving the confidentiality. If you revoke your consent, the pertinent data are erased immediately. However, within the context of a business relationship we reserve the right to collect and request personal data from you as needed for specific purposes (phone number, email address). 

A request for information can also be sent to data-protection@fms-logistics.com while preserving confidentiality.

Access to Your Personal Data

When you are in a business relationship with FMS, your data are transmitted to the competent company department or to in-house systems as required to carry out an order. Your personal data are only passed on inasmuch as this is necessary to process your order efficiently.

Your data are stored on in-house servers of FMS. Your data are only accessed by authorized persons in the context of a business relationship and by staff members in the IT Operations Department inasmuch as this is necessary for the maintenance of the system (especially servicing and repair work) and to ensure data security. All persons who are authorized to process personal data and can access your personal data are pledged to confidentiality in accordance with the legal provisions. Your data are only transferred to third parties (e.g. authorities) to the extent that this is legally permissible, for instance when transmission is required to comply with a legal obligation to which FMS is subject (art. 6(1) lit. c GDPR).

Erasure of Data

Your personal data will be erased as soon as they are no longer required to carry out a joint business relationship. This does not apply to the extent that your personal data are subject to legally stipulated retention obligations which require storage of the data beyond the duration of the business relationship.

Data Security

Taking the state of technology, the risks posed by processing, and the protection requirements concerning your data into account, FMS has taken suitable technical and organizational measures to protect the personal data provided by you pursuant to the legal provisions, especially art. 32 GDPR.

Your Rights as Data Subject

As a business partner you are a data subject within the meaning of the GDPR and you have the following rights toward FMS: 

You have the right to information regarding the personal data FMS has stored about you. You may exercise this right by contacting our Data Protection Officer by sending an email to data-protection@fms-logistics.com. The information you receive must include a copy of your data which, in addition to your personal data, also states the recipients of data, the purpose of the storage, and all other legally required information pursuant to art. 15 GDPR. Upon your special request the data will be provided in a structured, standard, and machine-readable format. The competent IT department shall determine the applicable standard.

You have a right to the rectification of your personal data if they turn out to be inaccurate. You can also demand that incomplete personal data be completed.

You have the right to request the erasure of your personal data if one of the following grounds applies:

  • knowledge of the data is no longer necessary in relation to the purposes for which they were stored;
  • you have withdrawn your consent and there is no other legal ground for the processing;
  • the processing of the personal data is unlawful;
  • you invoke a right to object based on a special personal situation (which you must substantiate);
  • the personal data are special data whose correctness cannot be proven, or
  • another legal obligation to erase the data exists.

If there is an obligation to erase and the personal data have been made public, other data controllers must be informed about your request to erase with respect to all copies of your data.

You may request that the processing of your data be restricted if

  • you contest the accuracy of your personal data, for a period enabling FMS to verify the accuracy of the personal data;
  • the processing is unlawful and you oppose the erasure of the personal data and request the restriction of their use instead;
  • FMS no longer needs the personal data for the purposes of the processing, but they are required by you for the establishment, exercise or defense of legal claims;
  • you have objected to processing pursuant to art. 21(1) GDPR pending the verification whether the legitimate grounds of FMS override our grounds.

Where the processing of your personal data has been restricted, such personal data shall, with the exception of storage, only be processed with your consent or for the establishment, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.

If the processing has been restricted pursuant to grounds specified above, FMS shall inform you before the restriction of processing is lifted. We will notify you within one month at the latest of any measures that have been taken in response to your request.

If you believe that the processing of your personal data violates the GDPR, you have the right to lodge a complaint with the competent supervisory authority.

Amendments to this Data Protection Statement

Changes in the legal regulations or internal business processes may necessitate amendments to this Data Protection Statement. The amendments to this guideline need not be formal to be effective, and FMS shall suitably notify you of such amendments.

Anonymous data collection

In principle you can visit the websites without informing us who you are. We only get to know the name of your internet service provider, the websites you visit us from and our websites you visit. These information are evaluated for statistical purposes only. You as a single user remain anonymous.

Collection and Processing of Personal Data

Personal data is not collected on our webpages which serve purely to provide information.

Export and Processing of Data Outside of the EEC

Since no personal data is collected, no data is exported to countries outside of the EEC.

Cookies

A cookie is a small text data file, which a webserver sends to your internet browser and which is placed on the hard disk of your computer. No other personal data of the user except the IP address will be stored. These pieces of information help the system to recognize you during your next visit on our websites. They also make the navigation easier for you. Each time our website is visited our webservers store automatically general information in anonymous form. You have the right to object to the storage of data with future effect at any time.

This website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses "cookies", which are text files placed on your computer to help analyse how users use the site. The information generated by the cookie about your use of the website will be transmitted to and stored by Google on servers in the United States. On our website we use the walls.io tool from “Die Socialisten” Social Software Development GmbH, Andreasgasse 6, Top 1, 1070 Vienna to present our social media content. The privacy policy of walls.io can be found at www.walls.io/privacy. We have concluded an order processing contract with the provider. Social media content is integrated using walls.io on the basis of Art. 6 Para. 1 S. 1 lit. f GDPR for the appealing presentation of our online offers. By integrating walls.io, information about the use of this website and your IP address is transmitted to walls.io and stored. We have no precise knowledge of the exact content of the transmitted data or of their use. Walls.io may share information with third parties, particularly through your interactions. Data can be transmitted to the social media service, interactions can be assigned to your profile or published on your behalf. Privacy Notice for Applicants 

The applicant management tool of FMS (referred to as the "FMS Online Tool") is a web-based application of Fr. Meyer's Sohn (GmbH & Co.) KG and the companies affiliated with it and participating in the system (collectively referred to as "FMS", "us", "we", and "our companies"). FMS operates this application worldwide for the posting of career opportunities and the handling of the application process. Using the FMS Online Tool gives you the ability to access our worldwide job market at any time.

The protection of your personal data is important to us. We would therefore like to inform you about our data privacy principles below. Compliance with them is obligatory for every FMS company to which you apply using the FMS Online Tool.

Application-related data

The personal data that you provide over the course of your online application will be processed exclusively for application purposes in accordance with the applicable data protection regulations. The legal basis for the data processing is Article 6(1) point (b) / Article 6(1) point (f) of the General Data Protection Regulation (GDPR), supplemented by any applicable national statutory regulations, e.g. for Germany Article 88 GDPR in connection with Section 26(1) of the Federal Data Protection Act (BDSG). 

If you submit application documents that contain "special categories of personal data" pursuant to Article 9 GDPR (e.g. a photo that can be used to identify your ethnicorigin), please note that you are not obligated to do so. Such data are generally not required for the execution of the application procedure. The legal basis for the processing of these data is your consent in accordance with Article 6(1) point (a) GDPR in connection with the respective national statutory regulations, e.g. for Germany Article 88 GDPR in connection with Section 26(2) of the Federal Data Protection Act (BDSG). We would like to evaluate all applicants exclusively on the basis of their respective qualifications and kindly request that you abstain from providing such information in your application as much as possible.

If you nevertheless provide your consent, you can withdraw your consent without providing a reason by using the contact details provided at the bottom of this privacy notice. . If you withdraw your consent then the data within the scope of your consent will be immediately erased; your application will then be restricted to your "adjusted" application.

If we should learn that you have not yet reached the age of sixteen and do not have the consent of your parents or legal guardian then we will unfortunately not be able to take your application into consideration and will immediately erase your data.

Apart from that, we reserve the right to request original documents (e.g. of school reports and work references) over the course of the application procedure in order to collect further personal data from you.

Access to your personal data

If you have applied for a position then your data will be forwarded to the responsible specialist department or HR department as well as to the prospective superior for that position, insofar as this is required. 

If you apply for multiple positions in different FMS companies at the same time, the HR departments concerned will also be informed of your applications being processed in parallel. In this case your personal data will only be forwarded if this is necessary for the efficient processing of the applications.

Your data will be stored in the data center of Noris Network AG in Nuremberg. Your data will only be accessed by P&I AG, the companies that provide us with technical support to make the FMS Online Tool available, to the extent that this is necessary in order to maintain the availability of the system (particularly maintenance and repair work) and to ensure data security. All of the individuals who are authorized to process personal data and who can access your data are legally obligated to maintain confidentiality in accordance with the statutory provisions.

Apart from that, we will only disclose your data to third parties (e.g. authorities) to the extent to which this is legally permitted, e.g. if the disclosure is necessary in order for FMS to fulfill a legal obligation in accordance with Article 6(1) point (c) GDPR.  

Data deletion 

Your personal data will be erased as soon as they are no longer required for the execution of the application procedure but at the latest 6 months after the conclusion of the application procedure for the position concerned. This shall not apply if your personal data are subject to statutory retention periods that require the retaining of the data beyond this period of time, e.g. any e-mail communication between you and the HR department of FMS.

If you are hired then your personal data will be transferred to our personnel administration system and processed further there.

If your application is unsuccessful then we will only add your data to our applicant database and use it with your consent subject to the provisions above, e.g. in order to contact you with regard to other positions that may be of interest to you. 

Data security 

Taking into account the latest state of the art, the risks arising from the data processing and the required level of protection, FMS has taken appropriate technical and organizational measures to protect the personal data that you provide in accordance with the statutory provisions, in particular Article 32 GDPR. 

Your rights as a data subject 

As an applicant, you are a data subject within the meaning of the GDPR and are entitled to the following rights with regard to FMS:

You have the right of access to the personal data being stored about you by FMS. If there is any reasonable doubt concerning your identity then FMS may request additional information from you. The information will be provided in writing unless you requested to be informed electronically. The information is to be accompanied by a copy of your data which, in addition to the existing data about your person, also includes the recipients of data, the purpose of the storage, and all other information legally required in accordance with Article 15GDPR. At your special request the data will be provided in a structured, commonly used and machine-readable format. The responsible IT department will define the standard to be provided for this. 
You have a right to the rectification of your personal data if they prove to be inaccurate. You likewise have the right to have incomplete personal data completed.

You have the right to the erasure of your personal data under the following conditions:

  • the personal data are no longer necessary to fulfill the purpose of their storage;
  • you have withdrawn your consent and there is no other legal ground for the processing;
  • the processing of your personal data is prohibited;
  • you invoke a right to object based on grounds relating to a particular personal situation (which is to be justified); the data concerns special categories of personal data whose accuracy cannot be proven, or 
  • there is another legal obligation to erase the data.

If there is an obligation to erase the data and if the personal data was made public before this then other controllers for the data processing are to be informed of your request  to have all of the copies of your data erased.
You can demand the restriction of the processing of your data under the following conditions: 

  • if you contest the accuracy of your personal data for a period enabling FMS to verify the accuracy of the personal data;
  • the processing is unlawful and you oppose the erasure of the personal data and request the restriction of the use of the personal data instead; FMS no longer needs the personal data for the purposes of processing but you require the data for the establishment, exercise, or defense of legal claims, or 
  • if you object to the processing pursuant to Article 21 (1) GDPR pending the verification that the legitimate grounds of FMS override your grounds.

If the processing of the personal data relating to you has been restricted then these data –with the exception of their storage –shall only be processed with your consent or for the establishment, exercise, or defense of legal claims or the protection of the rights of another natural or legal personor for reasons of important public interest of the European Union or a Member State.

If the processing of the data was restricted in accordance with the conditions above then you will be informed by FMS before the restriction is lifted. 

We will inform you of any measures carried out on the basis of your respective request within one month at the latest.If you are of the view that the processing of the personal data relating to you violates the GDPR then you have the right to lodge a complaint with the responsible supervisory authority.

Changes to the Data Privacy Statement

It may be necessary to change this privacy notice in the event of a modification of the statutory provisions or of our application process. Changes to this notice take effect informally and you will be notified of them by FMS in an appropriate manner.
 

Privacy Notice for the Cruise Control web application

The usage of our online supply chain management system Cruise Control requires the collection, processing and storage of a limited quantity of personal data.
We require some of the data in order to set up and manage your user account or to tailor individual services. Other data - including in particular technical data - are on the other hand collected automatically by our IT system whenever the web application is visited. We require these data in order to ensure the error-free operation of the system for you.

Server log files

Whenever you visit our web application at www.fms-logistics.com/scm/login.html, certain information transmitted automatically by your browser to our server is collected and stored. This includes:

  • the IP address
  • the date, time and time zone of access
  • HTTP method
  • the requesting URI

We use additional logging and debugging outputs in order to analyze and rectify errors, which are temporarily stored in server log files. These log files are not attributed to any user and are deleted after ten days.
These data are not cross-referenced with data from other sources. The basis for data processing is point (f) of Article 6(1) GDPR, which permits data processing for the performance of a contract or in order to take steps prior to entering into a contract.

We collect, process and store the following personal data in order to enable access for you or in order to identify your user account unequivocally:

  • username

Usage of cookies

Session cookies
Cookies are small text files, which a website can store on a user's computer or save locally. Whenever individual pages are displayed Cruise Control uses so-called temporary cookies in order to facilitate navigation. These session cookies do not contain any personal data and expire at the end of the session. Cruise Control uses session cookies exclusively in order to establish the technical status of the application.

Usability cookies
Our dashboard displays user cookies in order to store temporarily the display status of components. These cookies remain valid after the end of the session, although do not contain any personal data, but rather only status descriptions such as "off", "on" or "collapsed" so that certain fields (e.g. filters) can be loaded in expanded form. This means that the values associated with "usability cookies" do not contain any personal information.

Notice
You can prevent your browser from installing cookies by adjusting its settings accordingly. However, please note that, if cookies are disabled, the proper operation of our web application may be impaired.

Privacy Notice for Cruise Control mobile

Certain personal data must be collected and processed and certain access privileges for your mobile end device must be obtained in order for the Cruise Control mobile app to be used to the full. If you do not agree to the terms and conditions and utilization requirements described below, please do not use the app.

Collection of personal data by the Cruise Control mobile app

The Cruise Control mobile app can only be used if you have access to our Cruise Control web application. Personal data such as for example the user's first name, surname, email address, user role etc. are collected and stored within the Cruise Control web application. These data are made available within the Cruise Control mobile app in order to enable your account to be used on the move through the web application. All information relating to the collection, processing and storage of personal data by the Cruise Control web application may be found in the relevant Privacy Notice. The Cruise Control mobile app collects, processes and stores exclusively the following data:

  • the IP address of your mobile end device in conjunction with the FMS server
  • username
  • password
  • The display of a photograph in the user account, where an image has been stored under gravatar.com
Privileges: access to your mobile end device

As part of the installation process you will be informed of the access privileges required by the Cruise Control mobile app on your mobile end device. You can grant an access privilege by confirming the corresponding dialog during the installation process. The app may in principle be installed even if you have not granted any access entitlements. However, if no access privileges are granted, you will only be able to benefit from limited functionality of the Cruise Control mobile app. The following access privileges are necessary in order to be able to use the Cruise Control mobile app to the full:

  • Microphone access: using voice commands as part of the search function
  • Access to the local device memory: for downloading and displaying documents
  • Access to the library: for uploading files to Cruise Control
  • Access to the camera and flash / torch: for using the bar code scanning features (not active at present). If required, the feature can also turn on the mobile torch in order to illuminate the item being scanned
  • Access to settings: in order to save the language setting permanently
  • Access to geolocation data: in order to determine your location (not active at present)
  • Access to the internet: in order to access the FMS website or the Cruise Control web application
  • Access to network settings: in order to retrieve the system network settings (mobile network and WLAN) from the mobile app
  • Access to the boot process: for service start or event handling when the mobile app is launched
  • Access to the vibration alarm: for user feedback on the mobile end device
  • Access to the telephone: in order to provide telephone number links
Usage of cookies

The Cruise Control mobile app uses cookies in order to ascertain the technical status of the app. No cookies are used for the purpose of user tracking.


Social Media

Fr. Meyer's Sohn is present and active within social networks and platforms to communicate with interested parties and users and to inform them about the activities and services of Fr. Meyer’s Sohn. In order to comply with the required transparency obligation, we inform here about the processing and use of your personal data, as far as we know and can influence it.

Facebook

On our website we use a link to our Facebook fan page. Jointly responsible for the operation of our Facebook fan pages is Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. The data protection officer can be reached via the contact form or by post at the above address. Facebook Inc, is the American parent company of Facebook Ltd. Ireland and is EU-US Privacy-Shield certified. According to the requirement of Article 26 GDPR, an agreement for joint responsibility has been concluded. The purpose and legal basis of processing data

You can access our social media fan page at any time on the Internet, regardless of whether or not you have created a user account on the platform in question. If you are logged in to your facebook account, facebook can assign this to your facebook account. In both cases, however, your data will be processed by the internet platforms of the social network.

Every time you access the social media platform, your IP address is recorded and saved. In addition, a cookie is usually set on your site, which stores your visit and other data about your visit to the social media platform. When calling up our facebook fanpages, your data will be transferred to the USA. Please note that Fr. Meyer’s Sohn has no influence on the collection of data and its further use by the social networks. For example, there is no knowledge of the extent to which, where and for how long the data is stored, to what extent the networks comply with existing deletion obligations, what evaluations and links are made with the data and to whom the data is passed on.

a) Facebook-Insights

Fr. Meyer’s Sohn and Facebook have a joint controllership to process personal data (comments, likes, etc.) for page insights ("Insights data").
We use "Facebook-Insights" to obtain a presentation of statistically processed data without personal reference. The statistical processing is generated and provided by Facebook. Fr. Meyer’s Sohn, as the fan page operator, has no influence on the generation and provision. The data processing carried out by us is to a limited extent. This enables us to determine the behavior of our users and use this information to optimize our posts. Through the "Facebook Insights" we can learn, for example, about the following static data: the number of times the fan page is called up, the activity of its visitors, the range of posts, calls as well as the average duration of video playback, data on which country and city our visitors come from and statistics on the gender ratio of our visitors. The associated personal data processing takes place exclusively on Facebook. It is also possible that personal data may be processed when visiting our fan page. Further information on the scope and processing of your personal data can be found in privacy policy of facebook under https://m.facebook.com/policy.php.

The legal basis for the storage of Insights data on our part is the balancing of interests in accordance with Article 6 Para. 1 f) GDPR, so that the fan page is optimised and attractive for visitors.

b) Contact requests and visitor activity

If you contact us through facebook messenger to inform yourself about our services or to share your feedback, we process your personal data on the basis of our legitimate interest in responding to your request in accordance with Article 6 Para. 1 f) GDPR and, if applicable, Article 6 Para. 1 b) GDPR, if your request is aimed at the conclusion of a contract.

Usually we receive the following data from you:

  • name, first name
  • age, place of residence (if they are public)
  • gender
  • information that you provide in your message or comment to us
  • if you have responded to our post and type of response, or you have shared or commented on it

The data will be deleted as soon as they are no longer required for the purpose of their collection and no legal obligations to retain them exist. For the personal data from Facebook messages, this is the case when the respective conversation with the user has ended. The conversation ends when it is clear from the circumstances that the matter in question has been finally clarified.

Rights of the data subject

As part of the joint contollership with Facebook, you can exercise your rights as a data subject in accordance with Article 15, 16, 17, 18, 20, 21 GDPR both on Facebook and with us.   • Range: Number of people who see a specific contribution; Number of interactions on a post.
  • Advertisement performance: number of people who have seen a paid ad.

Those statistics are used to steadily improve our LinkedIn online content and to better respond to the interests of our users. We cannot link statistical data with the profiles of our followers or individual users.

Fr. Meyer‘s Sohn receives via LinkedIn personal data if you actively transmit your data by sending a personal LinkedIn message or application. We use the provided data (e.g. name, surname) to respond to your query. Fr. Meyer’s Sohn also receives via LinkedIn personal data of you if you are using a pre-filled web form.
