General Terms and Conditions

Applicable Terms and Conditions for Freight Forwarding Services

The branches of Fr. Meyer's Sohn (GmbH & Co.) KG located in Germany provide their freight forwarding services exclusively in accordance with the Allgemeine Deutsche Spediteurbedingungen 2017 (ADSp 2017) (German Freight Forwarders' General Terms and Conditions 2017). The full text of the ADSp 2017 is available on our website at https://www.fms-logistics.com/en/general-terms-and-conditions and will be provided upon request. The ADSp 2017 contain limitations of liability for cargo damage in clause 23. The statutory liability under Section 431 of the German Commercial Code (HGB) amounts to 8.33 Special Drawing Rights (SDR) per kilogram (kg) of lost or damaged cargo. The ADSp 2017 further limit this liability to € 1.25 million per damage claim and € 2.5 million per damage event or 2 SDR per kg, whichever amount is higher in the individual case. In the case of multimodal transport which includes sea carriage, the maximum liability is generally 2 SDR per kg.

 

Special Terms for Sea Freight Services

In the case of individual contracts for the provision of ocean freight transportation and all related services, our General Terms and Conditions of Offer for Sea Carriage apply in addition to the ADSp 2017. NVOCC Services

To the extent that Fr. Meyer's Sohn (GmbH & Co.) KG provides NVOCC (Non-Vessel Operating Common Carrier) services as agent of FMS Seaways AG – licensed with the U.S. Federal Maritime Commission (FMC) under OTI/ORG. No. 022381 –, such services are governed exclusively by the General Terms and Conditions of FMS Seaways AG.
